EB-1C Multinational Executive or Manager

The EB-1C Multinational Executive or Manager category allows individuals to obtain their residency (green card) through their employment with a U.S. employer. The U.S. employer in the United States must have a subsidiary or affiliated company abroad, which has previously employed the foreign beneficiary for at least one year. As with all employment-based immigration petitions, the specific facts of the individual’s job, particularly in relation to the setup of the business, will be key in determining whether the individual can qualify as a multinational executive or manager.

EB-1C Visa Requirements

In order to qualify under this category, the individual must at a minimum demonstrate the following:

  1. If applying outside the United States, one must demonstrate that they were employed outside of the United States by a “qualifying entity” for at least one of the three years prior to filing in a managerial or executive capacity by a firm or corporation, or other legal entity, or by an affiliate or subsidiary of such a firm or corporation or other legal entity; or
  2. If applying inside the United States and working for the same employer by which the foreign beneficiary was employed overseas, the candidate must demonstrate that they were employed by the qualifying entity abroad for at least one year in a managerial or executive capacity, during the three years prior to entry as a nonimmigrant;
  3. That they seek to enter the United States to continue to offer services to the same employer, subsidiary, or affiliate, in a managerial or executive capacity;
  4. That the U.S. company has been doing business in the United States for at least one year prior to the filing.

 

Important things to know:

  • You need a qualifying entity to file the petition on your behalf, you cannot self-petition.
  • You must have a job offer from the qualifying entity and the company must be able to demonstrate their ability to pay your salary.
  • You can be inside OR outside the United States when this petition is filed on your behalf.
  • If your petition is approved, your spouse and children will be derivative beneficiaries.
  • You do not need a labor certification.
  • You cannot change your employer, or a new petition will be required.
