Consular Officers May Waive in-Person Interview Requirement for Visa Applicants

Visa interviews are a necessary part of the visa process, but in some cases, they can be avoided.

The Department of State has announced that, due to their limited capacity to process visa applications in a timely manner, they are expanding and extending their nonimmigrant visa interview waiver program at participating Consulates through the end of 2022 unless extended.

Visa interviews may be waived for certain applicants who are renewing ANY visa within 48 months of expiration OR are temporary workers and academics applying for initial H-1B, H-2, H-3, H-4, L-1 individual, O, P, Q, F, M and J visas.

How do I qualify for this waiver of visa interview?

This waiver is available for the above-described visas for persons who have ever been issued any type of visa (and overcome a refusal if applicable) OR

Have previously traveled with an approved ESTA- based on authorization obtained through the Electronic System for Travel Authorization (ESTA).

Therefore, you must have previously been issued a visa or traveled to the USA on ESTA. Further, you must apply for the waiver of interview with a consulate or embassy located in your country of nationality or residence.

How can I apply for an interview waiver?

You must check the website of the relevant U.S. embassy or consulate to confirm the if these services are currently offered and to find their specific procedure to apply for a visa without an interview.  You can find your consulate or embassy’s website by visiting travel.state.gov.

Consular resources and local government restrictions vary widely, and each consular section is continuously reviewing its capacity to adjudicate visa applications during this worldwide pandemic and as we address global issues and competing priorities. 

Although consular officers may waive the interview requirement as explained, the decision to do so is made at their discretion and on a case-by-case basis, even if you meet all the requirements.

Some U.S. consulates and embassies may choose not to implement these new rules. While your ability to get a waiver for the interview requirement is not guaranteed, it's certainly possible based on current policy.

What if I am not eligible for a waiver of the interview?

Applicants who are not exempt from an in-person visa interview must still appear for their appointment, bring all required documents, and answer any questions the consular officer may have. The type of visa you are applying for will determine what specific documents you need to bring with you. However, most visa applicants will need to provide a passport valid for travel to the United States, application form DS-160 confirmation page, photograph, and visa fee payment receipt.

If your visa has been lost or stolen, you must also provide a copy of Form DS-64 Statement Regarding a Lost or Stolen Visa or Passport. If your visa has been damaged, you must provide a copy of Form DS-158 Replacement visa for a Damaged Passport.
