Some foreign nationals may qualify for lawful permanent residency (green card), provided that they can demonstrate that they fall within one of the categories:
Amerasians
Widow(er) of US Citizen
Religious Worker
Battered or Abused Spouse or Child of US Citizen or Lawful Permanent Resident
Juvenile under Court Protection
Employee of Panama Canal Company
Canal Zone Government or U.S. Government in the Canal Zone
Physician
Veteran of U.S. Armed Forces
International Organization Employee.
Contrary to the process of applying for green card through a family petition, the foreign national will usually self-petition for permanent residence. Depending on the special immigrant category under which the foreign national falls and if a petition is required, the immigrant visa may or may not be immediately available. If the visa is immediately available, the foreign national may be able to apply immediately for the green card together with the petition.
